PRIVACY POLICY

Overview

This is the Privacy Policy of Emerald Botanical Oils, Inc., a California corporation (“Emerald Botanical Oils,” “we,” or “us”).  Our Terms of Service, which incorporate this Privacy Policy by reference, govern your use of the Site, including the purchase of Products through the Site.  Any capitalized terms that are not defined in this Privacy Policy are defined in the Terms of Service.

 

Please read the Terms of Service and this Privacy Policy carefully. IMPORTANT: BY USING THE SITE AND/OR PURCHASING PRODUCTS THROUGH THE SITE, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT PURCHASE PRODUCTS THROUGH THE SITE OR OTHERWISE USE THE SITE.

 

Types of Information We Collect.

We collect two types of information about our users: Personal Information and Aggregate Information.

Personal Information: This refers to information that identifies you as an individual. When you engage in certain activities on the Site, such as registering for an account, purchasing a Product, or sending us feedback, we may ask you to provide certain information about yourself.  Examples of Personal Information may include your first and last name, email address, mailing address (including zip code), telephone number, credit card or other payment information (if you choose to purchase a Product), and other identifying information.

Aggregate Information: This refers to information that does not by itself identify a specific individual. How We Collect and Use Information

We may collect Personal Information about you if you voluntarily provide it to us or if another User provides it to us. You may be required to provide certain Personal Information to us when you elect to use certain features of the Site, such as: (a) registering for an account on the Site; (b) purchasing a Product; (c) sending us an email message; (d) signing up for special offers from third party advertisers; or (e) submitting payment information.  

We use your Personal Information to enhance the operation of the Site, enable you to purchase Products, fill your orders for Products, improve our marketing and promotional efforts, statistically analyze Site use, improve our product and service offerings, and customize our content. We may use Personal Information to deliver information to you, including targeted advertisements, and to contact you regarding administrative notices. We may also use your Personal Information to resolve disputes, troubleshoot problems and enforce our agreements with you, including our Terms of Service and this Privacy Policy.

We and our third party business partners may also collect certain Aggregate Information. We do not separately collect Personal Information about your online activities over time and across different websites.  If you choose to click on an advertisement or other link displayed in the Site, we may track this information.  If we already have your Personal Information (because you or another user provided it to us), we may associate that Personal Information with your online activities over time and across different websites.  If you use a mechanism such as a web browser “do not track” signal to prevent collection of Personal Information about your online activities over time and across different websites, we will not deliberately attempt to override your choice.  However, technology in this area is evolving, and it is possible that the technology used on the Site may automatically override your choice without any deliberate action on our part.  Because of this, we cannot guarantee that your choice will be respected.  Furthermore, we cannot guarantee that a third party advertiser or business partner which has content embedded in the Site will not track your online activities over time and across different websites, nor how the third party business partner will respond to a “do not track” signal.

 

Release of Information

We will not sell your Personal Information to others.  

 

We may provide some of our services through contractual arrangements made with affiliates, service providers, partners and other third parties (collectively, "Service Partners"). We may share Personal Information with Service Providers in order to fill your orders for Products, process your payments, and otherwise make the Site function.  Please note that the use of your Personal Information by Service Partners and other third parties is governed by the respective privacy policies of those third parties.

Occasionally we may be required by law enforcement or judicial authorities to provide Personal Information to the appropriate governmental authorities. In such cases, we will disclose Personal Information upon receipt of a court order or subpoena or to voluntarily cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

We may also provide Aggregate Information about our customers' sales, traffic patterns, and related Site information to third parties, including advertisers, but these statistics do not include any Personal Information.

 

Finally, if Emerald Botanical Oils is involved in a merger, acquisition, asset sale, divestiture, or similar transaction, we may disclose Aggregate Information and Personal Information to the party that acquires Emerald Botanical Oils.

 

Use by Minors

The Site is not intended for use by anyone under 18, except with the explicit permission and under the supervision of a parent or guardian who accepts full legal responsibility for the minor's use. No person under 13 should disclose information on the Site. We do not knowingly collect or use personally identifiable information from children under 13. Any minor who has registered as a user by setting up an account with us may request and obtain removal of any content or information that he or she has posted on the Site.  To have such content or information removed, please email us at info@emeraldbotanicaloils.comto request removal.  Please note that removal of content or information posted on the Site does not ensure complete or comprehensive removal of the content or information if (for example) another party has copied or reposted the content or information.

 

Updates and Notices

Periodically, Emerald Botanical Oils may send you email communications detailing new features or promotions. You may “opt-out” from these messages by following the instructions contained in the email. We may also send you email messages about the status of your account or any notices as required by law. You may not opt-out of receiving these administrative emails so long as you continue to use this voluntary service.

 

Your Information, Apps, & Links to Other Websites

We may make third-party applications such as the Facebook Like button (each an “App”) available to you for use in connection with the Site. Also, the Site may contain links to other websites not owned by us (each a “Third-Party Site”).

Your interactions with each App and Third-Party Site are governed by the terms of service and privacy policy of the company providing the App or Third-Party Site. We are not responsible for the content or privacy practices of any third party, even if we happen to host or link to its Third-Party Site or App, and our Privacy Policy does not apply to information collected by any third party. YOU ASSUME ALL RISKS, INCLUDING BUT NOT LIMITED TO THE RISK OF IDENTITY THEFT, RELATING TO THE ACTS OF THOSE WHO GAIN UNAUTHORIZED ACCESS. The Site is hosted and operated in the United States of America. Those who access or use the Site from other jurisdictions do so at their own choice and risk and are solely responsible for compliance with local law.
